By accessing, downloading, installing, or using Instadate AI ("the Software," "the Service," or "our Technology"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Service.

2. Description of Service

Instadate AI provides artificial intelligence-powered dating assistance technology that helps users find matches and craft personalized messages on social media platforms. The Service includes proprietary algorithms, software, and intellectual property developed by Instadate AI.

3. Subscription and Payment

Access to Instadate AI requires a paid subscription. By subscribing, you authorize us to charge your payment method on a recurring basis until your subscription is properly cancelled in accordance with these Terms.

4. Refund Policy

By purchasing a subscription to Instadate AI, you acknowledge and agree that:

• No refunds, partial refunds, or credits will be provided for any reason, including but not limited to dissatisfaction with the Service, technical issues, or failure to use the Service.
• You have reviewed and understood the nature of the Service before purchasing.
• All charges are non-refundable regardless of usage.
• This no-refund policy applies to all subscription tiers, promotional offers, and any other payment made to Instadate AI.

5. Subscription Cancellation

To cancel your subscription, you must fulfill ALL of the following requirements:

• Complete Software Removal: You must remove all traces of Instadate AI software, applications, files, cached data, and any related components from all of your devices, including but not limited to computers, mobile devices, tablets, and any storage media.
• Continuous Usage Clause: Any continued use, storage, possession, or retention of the Software, its components, or derived data on any device constitutes continuous usage of our intellectual property and technology. While such materials remain on your devices, your subscription remains active and you will continue to be charged.
• Contact Support: After completely removing all software traces, you must contact our support team to request cancellation. Cancellations cannot be processed through automated means or self-service portals.
• Verification Process: Our team may require verification that all software has been removed before processing your cancellation request.

Please allow up to 30 business days for cancellation requests to be processed after all requirements are met.

6. Intellectual Property Rights

All aspects of Instadate AI, including but not limited to the software, algorithms, AI models, user interface, design, and documentation, are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal purposes only.

You acknowledge that:

• The technology, methods, and processes used by Instadate AI constitute valuable trade secrets and proprietary intellectual property.
• Possession or storage of the Software constitutes ongoing use of our intellectual property.
• You may not reverse engineer, decompile, or attempt to derive the source code of the Software.
• You may not distribute, sublicense, or share access to the Software with third parties.

7. User Conduct

You agree to use Instadate AI in compliance with all applicable laws and regulations. You are solely responsible for your interactions with other users on third-party platforms. You agree not to use the Service for:

• Harassment, spam, or any form of abusive behavior
• Violating the terms of service of third-party platforms
• Any illegal or fraudulent activities
• Impersonation or misrepresentation

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE ANY SPECIFIC RESULTS FROM USING THE SERVICE, INCLUDING BUT NOT LIMITED TO MATCHES, RESPONSES, OR DATES.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSTADATE AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

10. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Continued use of the Service after any changes constitutes acceptance of the new terms. It is your responsibility to review these Terms periodically.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
